Terms of Use

1. Agreement to Terms

By creating an account or using pin360 ("the Service"), you agree to be bound by these Terms of Use and our Privacy Policy. If you are accepting on behalf of an organisation, you represent that you have authority to bind that organisation to these terms. If you do not agree to these terms, do not use the Service.

2. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. The "Last updated" date at the top of this page will always reflect the most recent revision. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service and may cancel your account.

3. Service Description

pin360 is a web-based platform that enables structural engineers, building surveyors, and facilities managers to pin 360-degree panoramic photographs and inspection findings onto PDF floor plans and interactive maps. The Service includes optional AI-powered features such as defect photo analysis, smart notes, and inspection report generation.

AI Disclaimer

AI-generated analyses, notes, and reports are provided as assistive tools only. They do not constitute professional structural engineering advice and must be reviewed, verified, and approved by a qualified professional before being relied upon or issued to third parties. We make no guarantee as to the accuracy, completeness, or fitness for purpose of AI-generated outputs. You accept full responsibility for any reliance placed on AI outputs produced through the Service.

4. User Representations

By using the Service, you represent and warrant that:

• You are at least 18 years of age and have the legal capacity to enter into a binding agreement.
• All information you provide during registration and use of the Service is accurate, current, and complete.
• You will maintain the accuracy of such information and promptly update it if it changes.
• You have the authority to act on behalf of any organisation whose account you manage.
• Your use of the Service does not violate any applicable law or regulation.

5. Intellectual Property

The pin360 platform — including its software, design, trademarks, and documentation — is owned by us and protected by intellectual property laws. Nothing in these Terms grants you rights in the platform itself beyond the limited licence to use the Service during an active subscription.

You retain full ownership of all content you upload to pin360, including 360-degree images, flat photographs, and PDF floor plans ("Your Content"). You grant us a limited, non-exclusive, royalty-free licence to host, process, and display Your Content solely as necessary to provide the Service to you. This licence terminates when you delete Your Content or your account.

6. Prohibited Activities

You may use pin360 only for lawful purposes in connection with property inspection, surveying, facility management, or related professional activities. You agree not to:

• Upload content that infringes intellectual property rights, contains malware, or violates any applicable law.
• Attempt to access, probe, or test the security of our systems without written authorisation.
• Use the Service in any way that disrupts, damages, or impairs availability for other users.
• Use automated scripts, bots, or scrapers to access the Service or extract data without our written consent.
• Resell, sublicense, or commercially redistribute the Service or any outputs without our written consent.
• Misrepresent your identity or affiliation when using the Service.
• Use AI features to generate content that is intentionally misleading, fraudulent, or harmful.
• Upload images containing individuals without their appropriate consent where required by law (including UK GDPR).

We reserve the right to suspend or terminate accounts that violate these provisions without prior notice.

7. Subscriptions & Billing

Access to pin360 is provided on a subscription basis. By subscribing you authorise us to charge your payment method on a recurring basis via Stripe. The following billing terms apply:

• Free tier: A free plan is available with limited features and usage quotas. No payment method is required.
• Paid plans: Subscriptions are billed monthly or annually in advance, depending on the plan selected (Starter, Pro, or Enterprise).
• AI usage quotas: AI features (photo analysis, smart notes, report generation) are subject to monthly usage limits that vary by plan tier.
• Cancellation: You may cancel your subscription at any time via your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time.
• Refunds: We do not offer refunds for subscription fees already charged. If you believe a charge was made in error, contact us at support@pin360.io within 14 days.
• Price changes:We reserve the right to change pricing with at least 30 days' written notice. Existing subscriptions will be honoured at the current price until the end of their billing period.
• Failed payments: Failed payments may result in temporary suspension of access until outstanding amounts are settled.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or uninterrupted availability. We do not guarantee that the Service will be error-free, that data will never be lost, or that AI outputs will be accurate or complete.

9. Limitation of Liability

To the maximum extent permitted by applicable law, our total aggregate liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the greater of: (a) the total fees paid by you in the 12 months preceding the claim, or (b) £100.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence.
• Fraud or fraudulent misrepresentation.
• Any other liability that cannot be excluded or limited under the laws of England and Wales or Scotland.

10. User Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what data we collect, how we use it, and your rights under UK GDPR. By using the Service, you acknowledge that you have read and understood the Privacy Policy.

11. Account Termination

By us: We may suspend or terminate your access immediately if you breach these Terms, fail to pay fees, engage in prohibited activities, or if we are required to do so by law. We will provide notice where practicable.

By you: You may cancel your subscription and request account deletion at any time via your account settings or by emailing support@pin360.io.

Upon termination, your right to access the Service ceases. Your Content will be retained for 30 days to allow reactivation, then permanently deleted in accordance with our data retention policy (see Privacy Policy).

12. Governing Law & Disputes

These Terms are governed by the laws of Scotland and the United Kingdom. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Scotland. If you are a consumer in another jurisdiction, mandatory local consumer protection laws may also apply.
